Who will pay for my lost wages and medical bills?
Who will pay for my lost wages and medical bills?
This is a difficult question and it varies from case to case. If you are in a motor vehicle accident, your private medical insurance or PIP (personal injury protection) coverage on the vehicle you were in at the time of the accident will pay your medical bills, and perhaps wage loss, up front, before settlement of your claim. If you do not have medical insurance or PIP, the insurance covering the vehicle which you were in at the time of the injury will cover the payment of your medical bills and wage loss. Any other monies owed will be paid out of your final recovery when your case is settled.

Lynnwood Truck Accident Lawyer: FAQ
Q. How soon after an accident should I contact an attorney?
A. When dealing with a truck accident, it is important to make contact with an attorney as soon as possible. You can be sure that the trucking company is going to investigate the accident immediately. You need a lawyer who is on your side to do their own investigation just as quickly.
Q. If I wasn’t wearing my seatbelt when my truck accident occurred. Can this be held against me in a suit for damages?
A. According to the Washington State Safety Restrain Coalition web site, failure to wear safety restraints does not constitute negligence and cannot be used to prove negligence in a civil case.
Q. I have been asked to release my medical records to the truck driver’s insurance adjuster. Should I do this?
A. Absolutely not. Always consult a qualified personal injury attorney before releasing any information, or your case may be seriously impaired.
Q. If I file a personal injury claim, will we settle out of court or go to trial?
A. Many truck injury cases can be settled out of court. A lot depends on what the insurance company offers as a settlement for your claim. If we feel that the amount is fair to you, we will settle out of court. But if the offer is unacceptable, we may take the case to trial.

What Causes a Brain Injury?
A. Traumatic brain injuries occur when the brain is bruised or shaken by an abrupt impact to the head or violent movement of the head. If the injury is severe enough, a person will black out. Depending on how badly the blood vessels and nerves are stretched and/or torn, injury can be mild or very severe. Acquired brain injuries (ABI) occur without direct trauma to the brain, but rather by lack of oxygen, poisoning (such as lead) or electrocution. Severe loss of blood can also cause ABI. Patients can also suffer from post concussion syndromes after a brain injury. The constellation of symptoms may include head aches, light sensitivity, noise sensitivity, vertigo, dizziness, executive function problems, loss of memory or reduction in attention, concentration, difficulty speaking, walking, or other motor and sensory dysfunction, and/or other conditions.
If you or a loved one of yours has suffered traumatic brain injuries due to the negligence of another, financial compensation may be an option for you. For a free consultation with a Lynnwood brain injury lawyer at our firm, call 800-282-4878 today.
Washington Asbestos Removal Company Fined by State
Spencer Abatement Services, Inc., an asbestos removal company operating out of Puyallup, WA has recently been fined by Washington’s Department of Labor and Industries. The fines, totaling more than $400,000, concern asbestos removal that was performed at a former Lynnwood, WA high school and an Olympia, WA Transportation Department building. The contention is that the company did not appropriately follow safety regulations and workers were unsafely exposed to asbestos.
Asbestos is a naturally occurring mineral that, when disturbed, creates dust that can be inhaled and cause a variety of health problems including mesothelioma. Prior to public awareness concerning the potential health issues, asbestos was added as an ingredient to construction products for its resistance to heat, friction, electrical, and chemical damage. Because asbestos poses such dangerous health risks, special care must be taken in its removal from construction sites and ensuing disposal. These additional measures and expenses can sometimes lead to illegal asbestos removals.
The state is arguing that the company was removing asbestos that was not properly contained and not wet with water as rules require. In addition, workers on the job sites were not provided with a contamination area to shower and put on fresh clothes. The Washington authorities are reporting that the dust at the former Lynnwood High School site even caused one worker to seek medical attention for breathing problems.

Fatal Lynnwood Motorcycle Accidents Prompts Warning
Spring skies and rising gas prices could spell an early start to motorcycle season this year.
This weekend — the first real sunny patch in months — was witness to two fatal motorcycle crashes in Snohomish County.
A man in his mid-30s died in Everett on Saturday after reportedly running a red light at the intersection of Airport Road and Holly Drive, Everett police Sgt. Robert Goetz said. The motorcyclist collided with a sport utility vehicle in the intersection about 2:30 p.m. He died at the scene.
The crash remains under investigation, Goetz said.
Lynnwood police also are investigating a fatal collision between a motorcycle and a pickup truck Sunday night on Highway 99. The crash and the ensuing investigation shut down parts of the highway for several hours.
A Sultan man, 34, was riding his motorcycle northbound when he struck a pickup truck that was entering the roadway, Lynnwood police spokeswoman Shannon Sessions said. Speed appears to have been a factor in the crash.
Witnesses told police there may have been a second motorcycle and that may have played a role in the crash. Anyone with information should call officer Stephen Showalter at 425-670-5600.
“We would really like to talk to anyone who may have info,” Sessions said.
No other injuries were reported in either crash. The names of those killed weren’t released Monday, pending autopsy results and the notification of their families.
