In several of the child birth cases handled by this office, many of the babies and children have been catastrophically injured.  For example, children have sustained birth injuries of cerebral palsy, blindness, hearing loss, neurological damage, brain damage, burns due to being exposed to too much post-delivery heat in an oxygen sensitive environment and other serious injuries.  These are very sad cases, but we were able to financially prosecute on behalf of parents and families who did not have the ability to pay the charges for expert witnesses.  Given our years of experience in personal injury law, we have many expert physicians who will evaluate your case to see if medical negligence was committed.

Before any medical negligence cases are accepted, we exhaustively investigate the case. All medical negligence cases are defended and are costly. Therefore, before a medical negligence case is accepted and prosecuted to trial, it is important to know that the chances of success are excellent.

In June 2006, the Washington State medical malpractice statute was amended requiring a certificate of merit and a ninety day notice of intent to commence an action before a suit can be filed. Although the certificate of merit may no longer be necessary, you should check with a medical negligence lawyer immediately to timely investigate your potential medical negligence case before the statute of limitations runs.

postheadericon Teen Cyclist Killed While Training

The cycling community is in shock after the death of promising junior cyclist Adam Reyneke who was hit by a car while training on Tuesday.

Adam, 17, a matric pupil at Pretoria Boys’ High School, apparently died on impact.

He is the son of Pretoria cyclist and cycling shop owner Bruce Reyneke.

The family were at their farm in Ladybrand in the Free State during the school holidays.

They were too shocked yesterday to speak to the media, but a family friend said Adam was out on a straight, wide road training for the national junior race this weekend, when a vehicle apparently hit him from behind.

It is believed the boy died on the scene.

He was the younger of two children.

Eastern Free State police spokesperson Sergeant Majang Mosupa said the accident happened about 2km from the Maseru bridge.

Apparently a Toyota Corolla was travelling in the two-lane road, behind Adam, when another vehicle overtook it.

Mosupa said the Toyota swerved – as the driver thought the passing car was too close – and hit the boy.

Police are investigating a case of culpable homicide.

In reaction to Adam’s death, the family friend said: “Adam cycled all his life. One can almost say that he was on a bicycle shortly after he learnt to crawl.”

With Reyneke owning the cycle shop in Lynnwood for almost 21 years, his son grew up in front of his employees, who even sometimes baby sat him.

“Everyone who knew Adam is devastated,” the friend said.

Adam was becoming well-known in cycling circles as he usually finished races among the top 10. In February this year he won the junior category of the Carnival City Macsteel Cycle Classic.

Internet social website Twitter was abuzz with the news of Adam’s death yesterday, with friends and cyclists expressing shock and their sympathy for the family.

One wrote: “Just got news that Adam Reyneke, absolutely wonderful young guy and awesome talent, killed while training. Devastating.”

A Facebook page, “In loving memory of Adam Reyneke”, grew to 27 members not long after it was created. The site was for “all who knew and loved Adam. May the great memories live on!”.

Friends of the young cyclist wrote: “You will be safe in the palm of the Lord’s hand. RIP Adam.” Another said: “You are such an inspiration and legend to many. Keep a watchful eye from above – great things will happen because of you.”

Adam was described as a happy, wonderful and positive young man with whom his friends had fun. All said he would be greatly missed.

postheadericon Washington 18 Wheeler Accident

A Sunday morning, March 28, 2010 head-on collision claimed the life of a 24-year-old Orting man. The deceased motorist was reportedly headed the wrong-way down northbound Interstate 5 around 2:00 a.m., when he slammed head-on into a semi-truck near the Berkeley Avenue exit in Lakewood, as reported by The News Tribune.

The Washington State Patrol reported, a 2005 Honda Civic driven by Garrett M. Felt of Orting was driving in the wrong direction on I-5, when he slammed head-on into a tractor trailer hauling 59,000 pounds of cargo. Responding emergency crews pronounced Felt dead at the scene; he was not wearing a seat belt.

A 60-year-old Roy man was driving the semi during the collision. He managed to escape injury during the wreck. The State Patrol stated the semi truck driver “could not do anything to avoid being struck head-on by Felt.”

The Washington State Patrol started to receive calls about a wrong-way driver beginning at South Street on I-5. Felt apparently almost hit numerous other vehicles traveling on the interstate, which included a state trooper who was trying to tell him he was headed the wrong direction. Felt managed to drive six miles in the wrong direction before colliding with the tractor-trailer. The State Patrol is currently trying to determine if drugs or alcohol was involved. A full investigation is currently underway.

postheadericon Inmate’s Mother sues King County, Medical Staff Over Son’s Death

The mother of a King County Jail inmate whose grisly death from a bleeding ulcer figured prominently in a federal investigation into conditions at the downtown Seattle facility has sued the county and the doctor and nurses who failed to recognize his symptoms and get him help.

Testimony at an earlier inquest hearing showed that the 48-year-old Lynn Dale Iszley died after suffering for hours in agony while medical staff at the jail attributed his condition to heroin withdrawal. The inquest jury, in a rare finding against the county, determined that Jail Health Services contributed to Iszley’s death.

The lawsuit also names Dr. Anthony Rains, a Jail Health Services physician who treated Iszley. Rains resigned during an investigation into Iszley’s death. Also named were two Jail Health Services nurses, Flora Cruz and Eric Shirley, both of whom treated Iszley during the hours leading up to his death.

Update, 6:23 a.m., Mar. 19 James Apa, communications manager for Public Health — Seattle & King County, which oversees Jail Health Services, said the agency doesn’T comment on pending litigation. “Mr. Iszley’s death was tragic, and we extend our sincere condolences to the family,” he said.

Iszley had a long history of drug abuse and petty crimes when he was booked into the jail for drug possession July 15, 2007. He was sick from drug withdrawal and was seen by Jail Health Services staff several times over the next two days, according to the lawsuit.

On July 18, at 4:40 a.m., Iszley pressed the emergency call button in his cell and told a guard he thought his “liver had exploded.” The guard called for medical help, and a nurse responded, found Iszley’s blood pressure and heart rate normal, and said he could remain in his cell.

Four hours later, Iszley was found on the floor of his cell, shaking and sweating and unable to sit up without help. He was taken to the infirmary, where Rains found the inmate writhing in pain, his heart racing. Still, Iszley was kept at the jail infirmary where his condition continued to deteriorate.

The lawsuit alleges that Cruz and Shirley failed to notify Rains — who had gone home for the day — as Iszley’s symptoms worsened and the inmate slipped into shock. Rains testified at the hearing that, had he known the inmate’s vital signs — which included plummeting blood pressure and a racing pulse — he would have called paramedics and had him taken to Harborview Medical Center.

Instead, Iszley lay in the infirmary for hours as, an autopsy later showed, feces and the other contents of his ulcerated intestines spilled into his gut and caused a raging infection.

Around 5 a.m. on July 19, Iszley stumbled as he attempted to get up from his mattress in the infirmary. Other inmates helped him back to his bunk, and he refused breakfast. At 7:30 a.m., he was found dead.

Iszley’s death featured prominently in a sharply critical November 2007 letter from the U.S. Department of Justice’s Civil Rights Division, which found that the county routinely violated the civil rights of inmates in its care. The letter said Justice lawyers found “life-threatening” deficiencies in the health care of some inmates.

The county and the Department of Justice have since reached an accord — backed by a Justice suit — aimed at improving jail conditions.

My condolences to the family.

postheadericon Truck Accident Personal Injury FAQ

Q. Should I stay in my truck after an accident or get out?

A. Remain in the truck if you feel dizzy or feel any pain. Do your best to remain calm, and avoid changing positions. Pain in the neck or back can indicate a serious injury that could be made worse by climbing out of the truck. It is far better to wait for and ambulance or EMT than to end up crippled for life. No insurance claim is going to give your mobility back.

If your airbag deployed, there may be some haze in the cab, but there is no need to get out of the truck hastily unless you see fire or smell smoke. If the truck isn’t a safe place to be, then do what you have to do. Get out, and get as far away from any traffic as possible.

Q. What is the first thing I should do if I am in a truck accident?

A. First, if you or anyone else is injured, call 911. Give as many details as to your location as you can. Then call the police. While you are waiting, get as much information as possible, including name and contact information of the truck driver, license plate number, and contact information of passengers and eyewitnesses to the accident. Be sure to get insurance information.
