WA Rules of the Road: 46.61.021. Duty to obey law enforcement officer–Authority of officer

In this Chapter of the Lynnwood Rules of the Road, what is expected of you, the driver, when signaled to and eventually are pulled over by a police officer is stated and what the officer is allowed to check is identified.

(1) Any person requested or signaled to stop by a law enforcement officer for a traffic infraction has a duty to stop.

(2) Whenever any person is stopped for a traffic infraction, the officer may detain that person for a reasonable period of time necessary to identify the person, check for outstanding warrants, check the status of the person’s license, insurance identification card, and the vehicle’s registration, and complete and issue a notice of traffic infraction.

(3) Any person requested to identify himself or herself to a law enforcement officer pursuant to an investigation of a traffic infraction has a duty to identify himself or herself and give his or her current address.

Failing to stop for police is not only a felony criminal offense, but it can, and often does, result in serious injuries to people across the country. If you’re one of these people who have been injured because of another driver’s negligence, there’s no reason you shouldn’t contact a personal injury attorney to discuss a potential monetary settlement.

Call 1-800-282-4878 now to schedule your free consultation with a Lynnwood personal injury attorney at our firm now.

GENERAL RULES IN CASE OF A MOTOR VEHICLE COLLISION

Generally speaking, when one is in an accident involving a motor vehicle, there are certain rules of thumb to follow:

Do not give a recorded or written statement.

Take photographs of the property damage and have them developed at once. Take photographs at the scene with your cell phone to show the property damage in the street and where the cars end up after the initial impact and collision before you move your car. Do not use a Polaroid.

Do not sign anything without a lawyer reviewing it first!

Do not discuss any matters concerning your injuries with the at-fault insurance company. You are under no obligation to give this information and should discuss nothing but the damage to your car and the need for a rental car or “loss of use” compensation. Remember to be on guard for the clever insurance adjuster who may try to trap you into giving an incomplete statement. Simply do not discuss the accident with the claims adjuster.

The train car that slammed into the back of another on Washington’s Metro system, killing nine people, was an older model that U.S. safety investigators had called for replacing or overhauling 13 years ago.

The car “telescoped” in the accident during the evening rush hour yesterday, Debbie Hersman, a National Transportation Safety Board member, said today at a press conference. The front end of the car was sheared off.

The board, which is investigating the deadliest accident in the Washington system’s 33-year history, had advised Metro that cars of that type would crumple in a crash after a January 1996 collision between two trains that killed a train operator. The agency recommended that Metro improve its rail cars’ crashworthiness.

NTSB investigators on the scene of yesterday’s accident will review the train operators’ phone and texting records and examine the track and signals, said Hersman, who has been nominated by President Barack Obama to serve as the safety board’s chairman.

“We don’t know at this point whether or not the operator could have seen the train ahead of them in time to stop,” she said. “We’re going to be conducting a thorough accident investigation.”

Washington’s Metro, run by the Washington Metropolitan Area Transit Authority, is the second-largest U.S. heavy-rail transit system after New York City’s subway, according to the American Public Transportation Association.

If a Washington accident results in an injury to you―whether physical or mental―you might be entitled to more compensation than the payout by the at-fault party’s insurance company. In fact, unless you specialize in tort law, you might not realize either how difficult your injury might make things for you―or the extent of your right to be paid for your trouble.

An experienced Washington Personal Injury lawyer will make it much simpler for you to get money in your pocket and fully compensated for your Washington personal injuries.
